the Money Forecaster Web Site (Site). By accepting this License Agreement or using this Site you are
agreeing to be bound by the terms and conditions of this Agreement. If you do not
agree to the terms and conditions of this Agreement, close this Site
and make no further use of this Site.
Use of this Site is licensed to you and not sold, for use only under the terms and
conditions of this Agreement. Money Forecaster reserves all rights not expressly
granted to you in this Agreement. Money Forecaster retains title to the Site,
and all intellectual property rights therein.
This Site contains copyrighted material of Money Forecaster. You agree that
you will not:
(i) disassemble, decompile, reverse engineer, modify or translate the Site;
(ii) sell, distribute, rent, lease, sublicense or otherwise transfer use of the Site
to a third party;
(iii) make any attempt to discover the source code of the Site; or
(iv) create derivative works from the Site;
Disclaimer of warranty: You acknowledge that money forecasting is a complicated
task. This Site is not designed as a substitute in any way for professional
advice in relation to that task. You agree to obtain appropriate professional advice
before using the Site for any purpose. Supplied with this Site are certain
notes and instructions and a failure to follow those instructions or notes carefully
could result in erroneous operations being undertaken, erroneous data being produced
or actions being taken or not taken by You. You should check all operations and
data produced before relying on the Site. The Site does not necessarily
comply with any legal requirements in your jurisdiction. The Site is licensed
on the strict understanding that, subject to the warranties below, Money Forecaster
is not responsible for the results of any operations performed by the Site or
actions taken, either by You or a third party relying on data supplied or not supplied
by the Site.
This Site including any and all associated materials, data and files are distributed
and provided "as is" and to the extent permitted by law with no warranties
of any kind whether express or implied, including without limitation, any warranty
of merchantability or fitness for a particular purpose. Money Forecaster does
not warrant or make any representations regarding the use of, or the results of
the use of this Site. Money Forecaster does not warrant that use of this Site
will be uninterrupted, error free, work with any particular combination of hardware
or software products and or that the Site will continue to work once updates
of any kind are applied.
To the extent permitted by law and except as expressly provided to the contrary
in this Agreement, all warranties whether express, implied, statutory or otherwise,
relating in any way to the subject matter of this Agreement or to this Agreement
generally, are excluded.
Where legislation implies in this Agreement any condition or warranty and that
legislation avoids or prohibits provisions in a contract excluding or modifying
the application of or the exercise of or liability under such term, such term shall
be deemed to be included in this Agreement. However, the liability of Money Forecaster
for any breach of such term shall be limited, at the option of Money Forecaster,
to any one or more of the following: if the breach related to goods: the
replacement of the goods or the supply of equivalent goods; the repair of such goods;
the payment of the cost of replacing the goods or of acquiring equivalent goods;
or the payment of the cost of having the goods repaired; and if the breach relates
to services the supplying of the services again; or the payment of the cost of having
the services supplied again.
To the extent permitted by law and except as expressly provided to the contrary
in this Agreement, Money Forecaster shall not be under any liability (contractual,
tortious or otherwise) to you in respect of any loss or damage (including consequential
loss or damage) howsoever caused, which may be suffered or incurred or which may
arise directly or indirectly in respect to the supply of goods or services pursuant
to this Agreement or an act, failure or omission of Money Forecaster.
You warrant that you have not relied on any representation made by Money Forecaster
or upon any descriptions or illustrations or specifications contained in any document
including any catalogues or publicity material produced by Money Forecaster.
This Site may include measures to prevent illegal or unlicensed use.
You agree that in order to protect the Site from piracy we may use these measures in this Site.
Technical support is provided at Money Forecaster’s sole discretion without
warranty or guarantee of any kind. While providing technical support, Money Forecaster
may determine that the issue is beyond the scope of Money Forecaster’s
Technical support. Money Forecaster can refuse, suspend or terminate any technical
support. It is your responsibility to ensure that you backup all of your existing
data before you receive technical support.
Money Forecaster in its sole discretion may at any time modify portions of this
Agreement. Money Forecaster can notify you of any changes by listing changes on
Money Forecaster’s website or by other means. Following notice of modifications
your continued use of this Site is deemed to be your acceptance of any such
modifications to the Agreement. After any such modifications, if you no longer agree
to the terms and conditions you must stop using the Site immediately.
This site is currently in a Beta period and is free to use until further notice.
Notice of any change will be made at such time on the Site.
Money Forecaster may terminate this Agreement at any time if you breach this
Agreement. If this Agreement is terminated your right to use the Site shall
completely lapse.
This Agreement shall be governed by and construed according to the law of Victoria
Australia. You irrevocably submit to the exclusive jurisdiction of the courts of
Victoria and the Commonwealth of Australia and any courts hearing appeals from such
courts. Any proceedings in a Commonwealth court shall be commenced in Victoria.
This Site is protected by copyright laws. Unauthorised reproduction or distribution
of the Site is subject to penalties.
